Harbour master's case against dismissal fails

A FORMER harbour master has lost a High Court action challenging his dismissal over complaints, including ones from former Tanaiste and Agriculture Minister Mary Coughlan, about his management of Killybegs fishery harbour in Donegal.

Captain Patrick J Kelly, Drumrooske, Donegal Town, was dismissed by the Government in September 2009 following an investigation which found he had private business interests at the harbour, in contravention of his role as a civil servant.

Mr Justice John Hedigan rejected Captain Kelly's challenge of his dismissal, in which he claimed those findings were tainted by bias, as was the decision to dismiss him, because the Minister was involved in making a complaint.
