‘Gay’ man sentenced to total of 29 years for rape of lesbian

A 46-YEAR-OLD man has been given four jail sentences totalling 29 years for the rape of a 20-year-old woman.

Samir Mansour – a North African national who has been living here since 2001 - had pleaded not guilty to charges of rape, sexual assault, false imprisonment and threats to kill at his flat on January 8, 2010.



Today Ms Justice Iseult O’Malley handed down two separate nine and a half year sentences on the counts of rape and sexual assault and a further six years and four years respectively for the other two counts.



All sentences are to run concurrently.



She suspended 18 months of each of the first two sentences and ruled that if the accused stayed in the country on his release from prison he would have to remain under the supervision of the probation and welfare service for five years.



Ms Justice O’Malley said the victim had been raped with such force that she suffered a deep internal laceration and bruises on the arms and legs. The accused had also threatened to kill her.



She had to undergo tests for hepatitis and other conditions, and suffered nightmares and panic attacks.



Ms Justice O’Malley said in handing down the sentence she was giving the accused - who worked as a chef - credit for a previously good record and work history. He was a foreign national with imperfect English.



There were bizarre scenes in the Central Criminal Court last week when the jury handed down a guilty verdict on three of the counts in the case and asked further questions about the fourth count.



Defence counsel Bernard Condon asked if the foreman had lost control of the jury and if they had in effect approached the verdict without understanding the requirement of proof beyond reasonable doubt.



During the seven day trial the court heard how the young woman had been out socialising with friends and her father and had gone on to a late night bar where she met Mansour, of Windmill Hill, Prospect, Mullingar.



She had told him she was a lesbian and he said he was gay too.



Although she did not really believe him, she thought he was harmless and a nice man.



He had invited her back to a party at his home and when they got there, he cooked her an omelette and then turned the TV to a pornographic channel.



She became concerned because no one was arriving at the flat for the party.



She went to the bathroom and tried to phone two friends but could not get through.



When she went to leave the flat the accused grabbed her by the arm and flung her back into the room.



She bit him in the chest leaving a bite mark but he was too strong and took her into the bedroom and raped her.



She said he made her give him oral sex and threatened to kill her if she did not stop resisting, he also threatened to poke her eye out, she alleged.



The accused has been married twice and has no previous convictions.
