ACTOR Gerard McSorley walked free from court after a couple hurt in a car crash allegedly caused by him refused to give evidence.

Garda Danny Costello had just started to give evidence in the case before Letterkenny District Court when Judge Paul Kelly was told there had been a development in the case.

The witnesses – who were not named in court – asked to speak to Inspector David Kelly at the back of the courtroom.

McSorley, (64), faced one count of careless driving at Cranford, Milford, Co Donegal, on May 14, 2011. The inspector told Judge Paul Kelly that the couple had earlier met McSorley, of 1 Cul Na Toinne, Bunbeg, Gweedore, Co Donegal, outside the court.

"He apologised to them and they do not want to proceed with the case," said Insp Kelly.

McSorley's solicitor Brendan Twomey confirmed the civil action had been completed, and Judge Kelly struck the case out.
