Family secure injunction over planned eviction from their home of 30 years

A FAMILY have secured a High Court injunction preventing South Dublin Co Council from evicting them from their home of almost 30 years.

The court heard David McGowan and his wife Catherine, who have lived with their three adult children and two young grandchildren at their home at Cushlawn Park, Tallaght, fear they they are in danger of imminent eviction arising out of a dispute over arrears of rent.

The council says the family are in arrears of €23,740, and earlier this year secured a warrant for possession of the property, which has been the subject of a tenancy agreement since they moved in 28 years ago.

The McGowans say that the council erroneously computed their family's income for rent assessment purposes.

The matter will come back before the court next week.
