Egg seller's case against rival scotched by judge

A FREE range egg seller has lost a bid to get an injunction to stop a competitor using boxes it claims are similar.

Galway Free Range Eggs Ltd, of Craigmore, Claregalway, which sells eggs under the 'Galway Free Range Eggs' brand, claims Hillsbrook Eggs Ltd, and its directors Kevin O'Brien and Carmel O'Brien, of Barnaderg, Tuam, passed off its product by selling under the name "O'Briens of Galway Free Range Eggs".

Yesterday, Mr Justice Paul Gilligan said he was not satisfied the packing used by the defendants "was likely to deceive the public".

He said Galway Free Range Eggs Ltd had not made out a serious issue to be tried or that its reputation or goodwill had been damaged by the defendant's product.
