Former Anglo Irish Bank chief executive David Drumm will appear before a US court on Tuesday.
There had been speculation tonight that the disgraced bank boss had been arrested by police at Brookline Police Department in Massachusetts ahead of a court appearance.
An officer in Brookline told independent.ie that Mr Drumm was not arrested by officers at that station and "he is not in Brookline".
Another representative at the station confirmed Mr Drumm was not there.
However, the officer said: "The US Attorney's office is going to issue a press release on this man going to court on Tuesday."
The US Attorney's office were not available for comment at the time of publishing.
The charges Mr Drumm is facing in court on Tuesday are not known.
Courts across the US are shut on Monday as it is a public holiday.
