A COUPLE who wanted former TD Mary O'Rourke to give court evidence over water damage to their home have lost their case.
The former TD had been subpoenaed to given evidence in an action by Donald and Anna McIntyre against insurance firm Allianz arising out of an arbitration award in late 2011.
The McIntyres got into dispute with the insurance firm in June 2008 over damage to their home at Ballyboy, Kilcormac, Co Offaly. But the High Court dismissed their claim against a €108,000 arbitrator's award.
It also ruled that Mrs O'Rourke was not required to give evidence in the case.
The McIntyres claimed the arbitrator Malachi Cullen was biased and had misconducted himself.
Ms Justice Mary Laffoy said there was no evidence of bias.
