Breast implant victim takes battle to foreign court

VICTIMS of defective silicon gel breast implants are having difficulty serving claims on a foreign-based parent company of the Irish clinic that carried out the surgery, a court was told.

The Circuit Civil Court was told that Harley Medical Group (Ireland) Limited may be only an Irish-registered branch of the company – which allegedly had its headquarters in the British Virgin Islands.

Counsel for breast implant victim Susan Newman, above, asked the court to grant leave to serve the proceedings outside the jurisdiction.

He said Ms Newman, a mother of three who had undergone her operation on February 22, 2006, was seeking to sue for breach of contract and also for personal injuries.

Proceedings had been issued in February last year just within the deadline.

Judge Jacqueline Linnane said that she could not yet grant leave to serve proceedings outside the jurisdiction and adjourned the applications until April 18.
