€380,000 payment to teen who suffered shoulder injury at birth
A TEENAGE girl who suffered a shoulder injury at birth settled her High Court action for €380,000.
Mary Griffin from Shanacloon, Fermoy, Co Cork the High Court heard suffers from Erbs palsy.
Through her father Donal, the 15-year old had sued consultant obstetrician Patrick Kieran of Orchard Road, Cork city and Bon Secours Health System Limited, College Road, Cork over alleged negligence during her birth at the Bon Secours Hospital, Cork in 1997.
Ms Justice Mary Irvine was told the settlement was against Mr Kieran and was without admission of liability and no order was to made against Bon Secours.
Ms Griffin had claimed that her mother, Catherine had attended Dr Kieran for pre natal care and was admitted to the Bon Secours hospital in February 1997 for the delivery of her baby.
It was claimed during the delivery, which was conducted by Mr Kieran and a medical team the baby sustained a permanent injury to her left shoulder and now suffers from a condition known as Erb's Palsy.
It was further claimed Dr Kieran failed to identify the risk of shoulder dystocia prior to or during the delivery. The claims were denied.
At the High Court today, Ms Griffin's Counsel Dr John O'Mahony SC said while the teenage girl has difficulty with her left upper limb, she had been doing very well and was a happy girl.
Ms Justice Irvine, who examined Ms Griffin's left shoulder in chambers, said she had no hesitation approving the settlement and said it was an excellent offer.
