Anti-Poolbeg group wins 'no-appeal data' ruling

RESIDENTS opposed to the Poolbeg incinerator should have been told how to appeal a decision to grant planning permission for the facility, it has been agreed in the High Court.
The Combined Residents Against Incineration (CRAI) group initiated court proceedings in January 2008 against the State.
Yesterday a settlement was reached in which the State admitted it had not complied with an EU directive over access to information. Agreed declarations were read out before Ms Justice Mary Laffoy.
The Department of the Environment last night said the directive would be transposed into Irish law. The action was taken against Ireland, the Environment Minister, Heritage and Local Government, the Attorney General and Dublin City Council. An Bord Pleanala was a notice party.
