Dispute settled over €135m plan for Cork project

A DISPUTE over an alleged agreement for a €135m wind farm project in Cork has been settled at the Commercial Court.
Mr Denis Cremins had claimed SWS Energy, Shinagh, Bandon, Co Cork, was in breach of a joint venture agreement (JVA) with him for the construction of a 29-turbine wind farm at Knockacummer, Co Cork, and was seeking orders restraining the development unless all conditions attached to it were fully complied with.
He claimed the wind farm now under construction was "entirely different" to that for which permission was granted in 2005 with "very significant" consequences for his personal property rights and for the environment.
Mr Cremins, of Muinganaire, Knocknagoshel, Co Kerry, claimed he entered into a JVA and other agreements with SWS in March 2003 as part of the development.
Mr Cremins claimed he agreed to the erection of nine wind turbines on his lands and to planning permission being sought.
He claimed the development carried out by SWS was unauthorised and not that for which permission was obtained.
He also claimed SWS was making no provision for hen-harrier habitat, as required.
